Appointment of Commissioner to the Scottish Law Commission

The Scottish Ministers are seeking applications for the position of Commissioner to the Scottish Law Commission.

The Scottish Law Commission is established for the purposes of promoting the reform of the law of Scotland and reviewing the law with a view to its systematic development and modernisation. You must be committed to keeping Scots law at the forefront of developments in a changing world.

Commissioners must be the holder of a judicial office, an advocate, or solicitor, or a teacher of law in a university.

The role involves:

  • contributing to the formulation of policy across all of the Commission’s law reform projects and to the preparation of discussion papers and reports to Government; and
  • contributing to the leadership of the Commission and so helping to deliver its objectives.
  • The responsibilities for the post will cover taking the lead on a number of law reform projects.
The Scottish Law Commission is currently undertaking projects under the Eighth Programme of Law Reform which runs until 2014. The responsibilities of the Commissioner appointed to this post will focus on the property law projects in the Eighth Programme. The Commissioner will act as the lead Commissioner on the following projects: moveable transactions (security over corporeal and incorporeal moveable property; assignation of incorporeal moveable property); prescription and title to corporeal moveable property; level crossings (a joint project with the Law Commission England and Wales); heritable securities; and the Commissioner will participate in a project on compulsory purchase; and provide further support and advice on behalf of the Commission if required on the recently published Report on Land Registration.

The postholder will also participate in such other law reform projects as identified.

The appointment is full-time, 5 days per week, for a fixed term of 3-5 years. Consideration may be given to flexible working to enable the successful candidate to work less than full time hours, although this would be a matter of negotiation. There may also be the possibility of reappointment subject to a number of conditions. Remuneration is £105,668 (pro rata if reduced hours are negotiated). The appointment is pensionable.

The post is based at the Scottish Law Commission offices at 140 Causewayside, Edinburgh.
