Unjustified threats on intellectual property rights

The Intellectual Property Office (IPO) has launched a consultation on possible reform of the law relating to unjustified threats to sue for infringement of a patent, trademark or design right.

These ‘threats provisions’ have been criticised in the past and in 2012 were subject to a review by the Law Commission, resulting in a report and draft Bill. The Government is now considering the Commission’s recommendations and is seeking views from stakeholders.

The consultation, which is available here, will close on 13th November.
