Call for evidence on bankruptcy legislation

The Scottish Parliament’s Delegated Powers and Law Reform Committee has issued a call for views on the recently introduced bankruptcy consolidation Bill.

The Bankruptcy (Scotland) Bill is intended to bring together existing legislation to create one accessible piece of law.

"Whilst in looking at consolidation bills the Committee doesn’t consider the policy behind the proposals, it’s important that as a Committee we understand if this Bill is necessary and if it consolidates the law clearly, coherently and consistently,” said Convener of the Committee, Nigel Don MSP.

The Committee is therefore asking for views in the following areas:

  • Do you think bankruptcy law should be consolidated?
  • Is it the right time to consolidate bankruptcy law?
  • Has the Bill captured everything it should?
    • Is the list of statutes consolidated complete?
    • Has everything from those statutes that should be consolidated, been consolidated?
  • Do you have any views on the approach taken in the Bill to consolidation?

The call for evidence will be open until 8th December.
