Cross-border family proceedings - proposal

The European Commission last week proposed improvements to the EU rules that protect children in the context of cross-border parental responsibility disputes related to custody, access rights and child abduction.

The aim is to speed up the legal and administrative proceedings and ensure that the child's best interest is always taken into account. In particular, the updated rules will:

  • Bring in more efficient procedures to tackle cross-border parental child abduction
  • Ensure the child is heard
  • Allow for rapid enforcement of decisions in other Member States
  • Improve cooperation between Member States' authorities

Timescales for this proposal are unclear, as it has still to be approved by the Council of the EU and the European Parliament will be consulted on the proposal.
