The Scottish Civil Justice Council has launched a public consultation as part of its review of how the Simple Procedure Rules are working.

Simple procedure, which replaced the small claims procedure for cases that have a value of £5,000 or less in the sheriff court, has been in place since November 2016. It is a court process that enables people to resolve civil disputes in an informal, speedy and inexpensive way. The Rules are laid out using accessible language and user-friendly guidance wherever practicable.

It was brought in after the Scottish Civil Courts Review recommended that changes be made to court practices and procedures in cases of low monetary value so that people who do not have legal representation can move through the court process effectively.

The consultation will run until 31st May 2018.
