Questionnaire on cohabitation provisions

The Scottish Law Commission is asking family law practitioners to complete a questionnaire about their experience of claims under the cohabitation provisions in the 2006 Act. It forms part of an ongoing review of aspects of family law.

The review, which is expected to take five years to complete, is being undertaken in phases, the first of which is looking at the law relating to cohabitants as set out in sections 25 - 28 of the Family Law (Scotland) Act 2006. An Advisory Group has been set up, which will help the Commission’s family law team in developing a Discussion Paper.

The hope is that responses to the questionnaire, about the experiences of family law practitioners and their clients in connection with the cohabitation provisions, will help the team’s understanding of the issues involved.
