Special Counsel

The Lord Justice General is inviting applications from advocates and solicitors seeking nomination to the list of special counsel.

As part of the new statutory disclosure arrangements introduced by the Criminal Justice and Licensing (Scotland) Act 2010 a court may, in criminal proceedings and by virtue of section 150(2), appoint a person (“special counsel”) to represent the interests of the accused in relation to those applications, reviews or appeals listed at section 150(1).

Rule 7A.8(2) of the Criminal Procedure Rules 1996 provides that special counsel shall be appointed from a list of persons who have been nominated for that purpose by the Lord Justice General.

Applications for nomination to the list should be in by 5pm on 23rd September 2011.

For further details and an application form see the Scottish Court website.
